Heard Ms. Khan, learned Advocate for Applicant and Mr. Kulkarni, learned APP for State.

Applicant in the present case is incarcerated for the past 4 years in an offence initially registered under Sections 307 and subsequently 302 which was alleged against unknown persons. Applicant is arrested on 27.06.2021 solely on the ground of suspicion as argued by the learned Advocate for Applicant. Case of prosecution is based on circumstantial evidence. Learned Advocate for Applicant informs the Court that charge has been framed, trial has not commenced and therefore ignominy of Applicant suffering further protraction in prison is argued by her for grant of bail on the ground

12_BA_1780_2025.docx of his long incarceration pending trial. In view of aforesaid facts prima facie Applicant has made out a case for grant of bail. 3.

Learned Advocate for Applicant is directed to serve a copy of Bail Application to the Respondent.

Learned Prosecutor shall take appropriate instructions on the veracity of submissions made by the learned Advocate for Applicant as also precise role of Applicant and apprise the status of trial and inform the Court on the next adjourned date to enable this Court to consider case of Applicant for grant of bail. 5.

Applicant is at liberty to move the vacation Court, if so desired.
