This is an Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Regular Bail in connection with C.R.No.69 of 2023 registered with CBD Belapur Police Station for the offence punishable under Section 302 of the Indian Penal Code, 1860 (for short 'IPC').

In the present case, Applicant is incarcerated in prison for the past 2 years. The victim in the present case is the wife of Applicant. Case of prosecution against Applicant is of he having inflicted a knife blow on the neck on the victim leading to her death.
19.BA.1792.25.doc Learned Advocate would inform the Court that a quarrel ensued between the Applicant and victim since the victim alleged malicious allegations against the Applicant, he refuted leading to the verbal altercation to escalate into a physical quarrel and unfortunate incident. 4.
He would submit that act of the Applicant would not amount to he having pre-mediated or planned to commit the murder of his wife in the given circumstances of the present case. Case of the prosecution according to him is on the basis of circumstantial evidence. He would submit that after the incident Applicant himself surrendered to the police.

Mr. Karmakar, learned APP appearing for the prosecution shall ascertain the veracity of the submissions made on behalf of the Applicant from the record of the case and accordingly apprise the role of Applicant in the crime to the Court on the next adjourned date. 6.
