By this application, the applicant is seeking regular bail in Crime No. 318 of 2024 registered with Bhosari Police Station, District Pune, for the offences punishable under Sections 307, 323, 504, 506, 143, 147, 148 and 149 of the Indian Penal Code 1860, Section 4(25) of the Arms Act, 1959, Section 37(1) read with 135 of the Maharashtra Police Act, Sections 3 and 7 of the Criminal Law Amendment Act and Sections 3(1)(ii) and 3(4) of the Maharashtra Control of Organised Crime Act, 1999. 2.

It is prosecution's case that on 16th May 2024, around 5:30 p.m., the applicant and co-accused assaulted the first informant and his

friend with a sickle with the intention to kill them. 3.

It is the contention of learned counsel for the applicant that the allegations against the applicant are of assaulting the first informant and his friend with fists and kick blows. The allegation of assault by sickle is against the co-accused. The learned counsel further submitted that the allegations against the Applicant are of catching hold of the victim. In the statement of victim recorded under Section 164 of Cr.P.C., the Applicant's role is not mentioned. The Applicant is behind bars for more than one year and nine months. The Applicant has no antecedents. There is no progress in trial, and requested to allow the Application.

It is contention of learned APP that, the Applicant has four antecedents. He was the part of group who assaulted the First Informant and his friend with an intention to kill them. If the Applicant released on bail, he may abscond or threaten prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant are that he caught hold the victim. The co-accused Yogesh Mule and Tejas Dongre having similar role have been released on bail. Hence, the Applicant is entitled for bail on

principle of parity and I pass following order.

ORDER

(i) The Applicant-Sachin @ Pirappa Jagannath Yere be released on bail in Crime No. 318 of 2024 registered with Bhosari Police Station, District Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
