Heard Mr. Tamhankar, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent.

Mr. Tamhankar invites my attention to the order dated 12.03.2025 appended at Exhibit-E, page No.398 of the Application. By virtue of that order, it was recorded that the status of trial was at the stage of recording of statement under Section 313 of the Criminal Procedure Code, 1973. There are total five Accused persons in the present crime.

Ms. Bajoria, learned APP fairly informs the Court that directions contained in paragraph No.2 of the order dated 12.03.2025 stands complied with. However, before the final arguments would begin, the concerned Judge in which the trial is going on has been

transferred in the interregnum and the Court is vacant. 4.

In that view of the matter, she would persuade the Court to consider extending the time which was stated in the order dated 12.03.2025, inter alia, in order to enable the trial to be completed. 5.

She would also inform the Court that even if concerned Court is vacant generally the work of concerned Court gets disbursed to the other companion Court but in present case considering the volume which is also endorsed by Mr. Tamhankar, there is prima facie less likelihood of the alternate Court also hearing the matter for compliance of order of this Court can be done. 6.

Ms. Bajoria, learned APP appears to be correct. In that view of the matter, I direct the concerned Principal District Judge of the Bombay City Civil and Sessions Court to take cognizance of the present case, peruse the order dated 12.03.2025 alongwith this order and assign final arguments in trial to alternate Court and ensure that the same is complied with within a precise time bound programme as expeditiously as possible and in any event within a period of eight (8) weeks from today positively.

Needless to state that if trial is not completed by then as directed hereinabove it shall be open to Applicant to move this Court. 8.

Copy of this order shall be immediately communicated to the

concerned Principal District Judge.

Stand over to 25th July, 2025.
