Heard Mr. Pandey, learned Advocate for Applicant and Ms. Gajare - Dhumal, learned APP for Respondent.

Applicant is incarcerated from 16.06.2022 for offences punishable under Sections 302 and 201 of the Indian Penal Code, 1860. Charge is framed in December - 2024 and trial has not been commenced till date.

Mr. Pandey draws my attention to page No.231 which is previous bail order passed by this Court allowing Applicant to withdraw the Bail Application on 07.11.2023 wherein it is stated that Applicant would have liberty to apply for bail if there is no reasonable progress done within six months. Hence present Bail Application is filed.

Considering the abysmally slow progress of trial and long incarceration of Applicant, prima facie, Applicant has made out a case for grant of bail.

Learned APP shall ascertain the veracity of submissions made by Mr. Pandey and accordingly inform the Court on the next adjourned date to enable the Court to consider the Bail Application of Applicant for grant of bail.

In view of paucity of time, Applicant is granted liberty to move Vacation Court if so desired.

List the Bail Application for hearing and disposal on 10th July, 2025.
