Heard Mr. Nadar, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

Considering the indictment of Applicant for offences punishable under provisions of the Indian Penal Code, 1860 and Maharashtra Control of Organised Crimes Act, 1999 (for short 'MCOC Act'), Respondent is directed to file Affidavit-in- Reply within a period of six weeks from today.

It is clarified that no further extension shall be granted to Respondent to file Affidavit-in-Reply unless exigency. 4.

Considering humongous period of incarceration of 4 years 2 months 7 days and charge not having been framed entitles consideration of Bail Application.

Learned APP shall ascertain the veracity of submissions made by Mr. Nadar and precise status of trial and accordingly inform the Court on the next adjourned date to enable the Court to consider the Bail Application of Applicant for grant of bail. 6.
