Heard Mr. Agarwal, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent.

The Applicant is incarcerated in prison from 26th May 2023 having been arrested in an NDPS offence. The Applicant is a young offender aged 20 years and he was 18 years old when he was arrested 3.

The learned Advocate would submit that indictment of the Applicant is alongwith invocation of provisions of MCOC Act and that accused No.1 is the gang leader having several antecedents against him. He would submit that considering young age of Applicant and his incarceration for the past two years, present application may be heard. He would also submit that accused No.3 arrayed in the present crime is a juvenile and he has been released on bail.

The Respondent is directed to file affidavit in reply within a

11 ba 1849-25.doc period of 6 weeks from today, positively and serve the same on Advocate for Applicant.

Liberty to move the Vacation Bench in view of the request made by the Advocate for Applicant with due notice to the prosecution. 6.

List the matter on 11th July 2025.
