Learned counsel for the Applicant submits that apart from non-compliance of Sections 42 and 50 of the NDPS Act, herein this case the grounds of arrest are not communicated to the Applicant. He submits that the Applicant came to be arrested on 22nd December 2023, and therefore in view of the judgment of the Pankaj Bansal v. Union of India1, the said compliance was mandatory as on the date of arrest of the Applicant. 2.
Learned APP seeks time to respond to the said argument. 3.
