Heard Mr. Jagtap, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

The Applicant is incarcerated in prison from 02.08.2020 for the past more than 4 years.

The learned Advocate would submit that Applicant had also filed a cross case against first informant who was injured and admitted to the hospital. He would submit that FIR having been registered could not be fructified since first informant succumbed to his injuries due to septicemic shock which is the cause of his death for which he was taking treatment in the hospital. On the issue of trial, he would submit that charge has been framed but trial has not been commenced and certainty of the trial commencing and concluding in the near foreseeable future is bleak. He would persuade the Court to grant bail

13 ba 1852-25.doc to Applicant also on the ground of parity since co-accused person has already been enlarged on bail.

Learned Prosecutor appearing for prosecution will consider the veracity of submissions made by Mr. Jagtap and apprise the status of trial and Applicant's role to the Court to enable the Court to consider the present bail application for release of Applicant on the ground of long incarceration pending trial.

Liberty to the Applicant to move the vacation court, if so desired.

6.

List the matter on 11th July 2025.
