By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 8 of 2020 registered with Koregaon Park Police Station, Pune City for the offences punishable under Sections 302, 143, 147, 148, 149, 323 and 504 of the Indian Penal Code Act, 1860 ("IPC" for short).

Mr. Ajinkya Udane, learned Advocate for the Applicant submits that the abovesaid crime is now registered as Sessions Case No. 35 of 2021 and is pending on the file of Additional Sessions

Judge, Pune.

Ms. Veera Shinde, learned A.P.P. for the State/Respondent submits that this Court by its order dated 19th April 2024 had granted liberty to the Applicant to file a fresh Bail Application after one year. She submits that the said liberty will have to be availed before the learned Trial Court, at the first instance. 5.

Mr. Ajinkya Udane, learned Advocate submits that he has instructions from the Applicant to withdraw the present Bail Application, as the Applicant intents to file a fresh Bail Application before the learned Trial Court in terms of liberty granted vide order dated 19th April 2024 passed in Criminal Bail Application No. 2640 of 2023. Liberty as prayed for by the Applicant is granted. 6.

Mr. Ajinkya Udane, learned Advocate submits that a fresh Bail Application will be filed before the learned Trial Court within a period of 10 days from today and therefore prays for expeditious disposal of the Bail Application. In the event any such Application is filed by the Applicant before the learned Trial Court within a period of 10 days from today, the Additional Sessions Judge, Pune is requested to make an endeavour to dispose of the same at the earliest and at any rate within a period of 6 weeks from the first date of hearing of the said Application.

Mr. Ajinkya Udane, learned Advocate assures the Court that no adjournment would be sought by the Applicant in the said Bail Application. Statement made by Mr. Ajinkya Udane, learned Advocate is accepted.

Mr. Ajinkya Udane, learned Advocate makes another request by pointing out to the orders dated 29th November 2024 passed in Interim Application No. 4910 of 2024 and dated 27th February 2025 passed in Interim Application (Stamp) No. 4293 of 2025, wherein the Applicant was released on interim bail subject to the conditions referred to therein. He submits that when a request was made to the learned Trial Court to release the bonds/surety amount, which were furnished while availing benefits of said two orders, the learned Trial Court has taken a view that such an order be secured from this Court, as the temporary bail was granted by this Court.

Be that as it may. Mr. Ajinkya Udane, learned Advocate submits that the Applicant had complied with the bail conditions and had surrendered himself upon the expiry of period of bail. 10.

In view of the same, the sureties furnished by the Applicant for availing benefits of the orders dated 29th November 2024 and 27th February 2025, are discharged.

Criminal Bail Application No. 1854 of 2025 is dismissed as withdrawn with liberty as prayed.
