On 31st July, 2025, Mr. Ali Kaashif Khan Deshmukh, learned Advocate for the Applicant, circulated a praecipe dated 31st July, 2025 seeking urgent listing of the present Application. He placed on record the order dated 24.07.2025 passed by the Hon'ble Supreme Court in Special Leave to Appeal (Crl.) No.10299 / 2025, directing this Court to dispose of the present Application within four weeks from 24.07.2025. In view of the said directions, the Application was listed today for hearing.

Ms. Anamika Malhotra, learned APP submits that the Applicant had filed Bail Application No. 3224 of 2022 before this Court, which Application was dismissed on merits, by order 28th February, 2024. She submits that Applicant had approached the Hon'ble Supreme Court by filing Special Leave Petition (Crl) No. 5909 of 2024, which was simplicitor withdrawn by the Applicant on 15.05.2024. She submits that in the event of change in circumstances, the Applicant is required to Gayatri Shimpi
902-BA-1859-2025.doc approach the Trial Court at the first instance. She submits that the Applicant having not taken the said recourse, this Court should not entertain the Bail Application and relegate the Applicant to the Trial Court.

Mr. Ali Kaashif Khan Deshmukh, learned Advocate for the Applicant, seeks an adjournment to respond to the objection raised by Ms. Anamika Malhotra, learned APP. Mr. Deshmukh seeks time till Tuesday, i.e., on 5th August, 2025.

Hearing in the present matter is adjourned to 5th August, 2025, on the request of Mr. Ali Kaashif Khan Deshmukh, learned Advocate for the Applicant.
