Heard Mr. Bhushan Raut, learned Advocate for the Applicant and Mr. Sameer Mangaonkar, learned A.P.P. for the State/Respondent.

By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 123 of 2023 registered with Vadgaon Nimbalkar Police Station, Pune Rural for the offences punishable under Sections 394, 397, 398, 342 and 471 read with 34 of the Indian Penal Code, 1860 ("IPC" for short) and Sections 3 and 25 of the Indian Arms Act, 1959.

Mr. Bhushan Raut, learned Advocate for the Applicant has circulated a praecipe of today's date, on instructions from the Applicant, seeking leave to withdraw the present Bail Application Gitalaxmi

902-BA-1903-2025.doc with liberty to approach the learned Trial Court in terms of the order dated 7th August 2024, passed by this Court in Criminal Bail Application No. 1071 of 2024. The same is taken on record and marked as "X" for identification. Liberty as prayed for by the Applicant is granted.

Mr. Bhushan Raut, learned Advocate, on instructions from the Applicant, submits that a fresh Bail Application will be filed before the learned Trial Court within a period of 5 days from today. Mr. Bhushan Raut, learned Advocate relying on the order dated 7th August 2024, makes a request for direction to the learned Trial Court for expeditious disposal of the proposed Bail Application. 5.

In the event any fresh Application for bail is filed by the Applicant before the learned Trial Court within a period of 5 days from today, the Additional Sessions Judge, Baramati is requested to make an endeavour to dispose of the same expeditiously and at any rate within a period of 4 weeks from the first date of hearing of the said Application.

Mr. Bhushan Raut, learned Advocate assures the Court that no adjournment would be sought by the Applicant in the said Bail Application. Statement made by Mr. Bhushan Raut, learned Advocate is accepted.

Criminal Bail Application No. 1903 of 2025 is dismissed as withdrawn with liberty as prayed.
