Heard Mr. Hogle, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent.

This is an Application under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.I-02/2022 for the offences punishable under Sections 302 and 201 of the PIC, 1860 registered with Ambernath Police Station. 3.
Applicant is indicted for the aforesaid offences and he is in incarceration from 2nd January 2022.

Learned Advocate would submit that trial has commenced but the progress is slow. He would submit that only 6 out of 37 intended witnesses desired to be examined by the prosecution have been examined before the trial court. He would therefore persuade the
9 ba 1909-25.doc Court to consider the case of Applicant being alleged on the basis of circumstantial evidence and long incarceration and Applicant be enlarged on bail.

Learned Prosecutor is directed to ascertain the veracity of the submissions made by the Advocate for the Applicant and accordingly apprise the precise role of the Applicant to consider the bail application considering his long incarceration pending trial. 6.
List the matter on 15th July 2025. Liberty to the Applicant to move the vacation court in view of his long incarceration in prison pending trial.
