Heard Mr.Arote, learned Advocate for Applicant and Ms. Gajare-Dhumal, learned APP for State.

Applicant is indicted under Section 302 and other allied Sections of IPC and came to be arrested on 04.10.2021 pursuant ot the incident in question. In all 7 accused persons have been arrested and 6 out of them have been relased on bail. Role attributed to the Applicant is that he has inflicted a single stab injury on the victim. 3.
Learned Advocate for Applicnt would persuade the Court to consider the fact that there was a dispute and quarrel which ensued between some of the co-accused persons and victim and Applicant were summoned by co-accused persons for their assistance and in the altercation which occurred and further escalated into a free fight, prosecution has alleged that Applicant inflicted a stab injury with a
23_BA_1927_2025.docx knife on the victim leading to his death. Knife has been recovered. Charge has been framed on 03.07.2024. Prosecution desires to examine a probable 28 prosecution witnesses in the trial. Considering the aforesaid facts and the fact that Applicant had not premeditated the assault on the victim, learned Advocate for Applicant would persuade the Court to consider the facet of long incarceration of Applicant for grant of bail. Prima facie if what the learned Advocate for Applicant is submitting is true, then a prima facie case has been made out.

Learned Prosecutor shall take appropriate instructions on the veracity of submissions made by the learned Advocate for Applicant and ascertain the precise role of Applicant in the present crime and apprise the Court about the same on the next adjourned date.

Stand over to 15th July, 2025.

At the request made by learned Advocate for Applicant, liberty is granted to Applicant to move the Vacation Court after giving due notice to the prosecution.
