1.
Heard Ms. Mishra, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.
2.
Applicant is indicted for past 1 years 5 months 4 days in the offences punishable under Sections 279, 336, 411, 413, 414, 420, 465, 467, 468, 471, 482 and 34 of the Indian Penal Code, 1860 (for short 'IPC') and Sections 179 and 184 of Motor Vehicles Act, 1988. 3.
The case of prosecution for invocation of aforesaid provisions of the IPC is because of Applicant not following protocol, breaking traffic barriers and over speeding his car and when apprehended found with false and fabricated documents. There were five Accused persons in the car out of which two out of the five Accused have been enlarged on bail.
27.BA.1933.2025.doc 4.
Ms. Mishra would persuade the Court to consider the gravity of offence and period of long incarceration of Applicant in the said offence which is prima facie borne out from record of the case and allow the Application for bail in the present circumstances. 5.
Prima facie, I have perused the record of the case. Learned APP is directed to take appropriate instructions on the precise role of Applicant qua the present crime in question. 6.
Ms. Mishra would candidly inform the Court that there are three antecedents against Applicant but in so far present crime is concerned it would have to be viewed and visualised from the present circumstances only and therefore seeks indulgence for grant of bail to Applicant.
7.
Learned APP is directed to apprise about the precise role of Applicant to enable the Court to consider the Bail Application of Applicant on the next adjourned date.
8.
However, considering the facts of the case and request made by Ms. Mishra, liberty is granted to move the Vacation Court. 9.
Stand over to 15th July, 2025.
