By the present Application, the Applicant is seeking bail in connection with Crime No. 1282 of 2022 registered with Shivaji Nagar Police Station, for the offences punishable under Sections 376, 376 (2) (n), 376(2)(f), 506 and 328 of the Indian Penal Code, 1860 and under Sections 4, 6, 8, 10 and 12 of the Protection of Children from Sexual Offences Act, 2012.

After having heard the matter for some time, Ms. Samiksha Pawar, learned Advocate for the Applicant, on instructions from the Applicant, craves leave to withdraw the present Bail Application and seeks liberty to file a fresh Bail Application before the Trial Court upon the victim in the present crime being examined in Special Case No. 249 of 2023, pending before the Court of Special Judge under the POCSO Act, City Civil & Sessions Court, Greater Mumbai. Mr. Dinesh Haldankar, learned APP for the State, on instructions from the Investigation officer, states that presently the Complainant (PW-1) is in the witness box. He submits that the prosecution would complete the examination of PW-1 and thereafter make an endeavor to examine the victim in the present crime at the earliest. He submits that the said exercise would be positively undertaken within four months from this order being placed before the Court of Special Judge under the POCSO Act, City Civil & Sessions Court, Greater Mumbai.

Leave to withdraw this bail application granted. 5.

In the event a fresh Bail Application is filed before the Trial Court upon the completion of the examination / recording of the oral testimony of the Complainant (PW-1) and the victim in Special Case No. 249 of 2023 , the learned Trial Court to consider the bail application on its merits and in accordance with law.

Ms. Samiksha Pawar learned Advocate for the Applicant, undertakes to place this order before the learned Sessions Court within a period of two weeks from today.
