Heard Mr. Salunke, learned Advocate for Applicant and Ms. Gajare - Dhumal, learned APP for Respondent.

Applicant is incarcerated for the past 7 months for offences punishable under Sections 109, 352, 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Sections 37(1)(a) and 135 of the Maharashtra Police Act, 1951.

Motive for committing crime is escalation of verbal arguments with the injured victim when injured victim asked him the reason for harming his friend. Weapon used is knife. It has been recovered from Applicant.

Mr. Salunke would submit that when weapon was recovered it was not smeared with any stain. He would candidly point out that

4.BA.1956.2025.doc injury certificate appended at page No.77 to submit that injured victim has received one grievous injury and allegation of prosecution is that Applicant inflicted a blow with sharp weapon. He would submit that there was no pre-meditation or plan to commit the crime and the incident resulted in view of a verbal altercation between the parties. 5.

On antecedents he would candidly inform the Court that there are five cases against the Applicant and he has been enlarged on bail in the same.

Learned APP shall ascertain the veracity of submissions made by Mr. Salunke and accordingly apprise the Court about the precise role of Applicant to enable the Court to consider the Bail Application of Applicant on the next adjourned date.
