On the last date of hearing, this Court after recording submissions of both sides as directed to Trial Court to submit report in respect of the videos collected during the course of investigation indicating involvement of the Applicant in the crime. Perusal of the said report does not show involvement of the Applicant in the crime as he can not be identified from the same. In the light of this facts, it relevant to note that the similarly placed co-accused has been enlarged on bail by order dated 13th February 2025 passed in Bail Application No. 3751 of 2023.

Learned APP was unable to point out the distinction in the role attributed against the present Applicant as compared to the

co-accused who is already enlarged on bail. Apart from the fact that there is similar role attributed to both of them, the evidence in the form of video is also not found to be incriminating against the present Applicant. Applicant has no criminal history. In such circumstances, this Court is left with no other option to grant bail on parity. Hence, following order.

ORDER

i) Criminal Bail Application stands allowed in connection with Crime No. 230 of 2023 registered with Mankhurd Police Station, Mumbai, for the offences punishable under Sections 363, 370(d) (a), 342 of the Indian Penal Code, 1860 and Section 6(1) read with 5(g) of the Protection of Children from Sexual Offences Act, 2012 and Section 67 (B) of Information Technology Act, 2000.

ii) The Applicant be enlarged on bail, on furnishing P. R. Bond of Rs.30,000/- with one or two sureties in the like amount, to the satisfaction of the Trial Court.

iii) The Applicant shall mark his attendance with the concerned Police Station on First Saturday of each month between 11:00 a.m. to 2:00 p.m., till framing of charge.

iv) The Applicant shall remain present before the Trial Court on each date unless exempted by the Trial Court.

v) The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, victim, witness or any person concerned with the case.

vi) The Trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law.

vii) Any breach of the above condition shall result forthwith in cancellation of bail.

The application is allowed in aforestated terms and is accordingly disposed of.
