There is an order dated 17th February, 2025, passed by a co-ordinate Bench of this Court, wherein this Court had directed the Applicant to withdraw the bail application with liberty to file a fresh bail application after recording evidence of the victim.

Today, I am told that the charges are framed and the next date of hearing in the present case is tomorrow i.e., 3rd December, 2025. There is possibility that statement of the victim may be recorded tomorrow.

Since the charges are framed and the Applicant is in custody since 24th January, 2023, the Trial Court is requested to record the statement of victim at the earliest, and preferably within a period of three months from today. 4.
The Applicant is permitted the renew his prayer for bail once the statement of the victim is recorded as already been mentioned in order dated 17th February, 2025. 5.
In view of the aforesaid, Mr. Agarwal, learned counsel for the Applicant, on instructions, seeks permission to withdraw the present Bail Application with a liberty to move a fresh bail application once the statement of the victim is recorded. Permission is granted with the aforesaid liberty. 6.
