At the very outset, Mr. Kiran Shinde, learned APP representing the State, brought to my notice that notice issued to the Respondent No.2-Victim is served and mother of the victim is present in the Court. She requires legal aid and hence, Ms. Aneesa Cheema, learned Advocate from the Legal Aid Panel, is appointed to espouse the cause of the Respondent No.2.

Learned counsel for the Applicant is directed to serve a copy of the Bail Application along with annexures on the learned counsel for the Respondent No.2, within one week from today.

Mr. Ashley Cusher, learned counsel appearing for the Applicant, draws my attention to an order dated 2nd April 2024 passed by this Court in Bail Application No.3953 of 2023 (First bail application preferred by the Applicant) wherein the Court recorded its disinclination to grant bail after hearing the parties on merits. However, the Court granted liberty to the Applicant to file a fresh bail application after one year if there was no substantial progress in the trial.

Mr. Shinde, learned APP, on instructions, submits that till date, charges are not framed.

In these circumstances, the Trial Court is directed to frame charges and record the deposition of the victim within a

List the matter for further consideration on 5th January 2026.
