By this Application, Applicant is seeking regular bail in Crime No.183 of 2022 registered with Warje Malwadi Police Station, Pune, for the offences punishable under Sections 302, 201, 120B, 364 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short), Sections 3 read with Section 25 of the Arms Act.

It is prosecution's case that the Applicant and co-accused kidnapped the deceased and murdered him on the ground that the deceased had financial dispute with Accused No.1.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than three years and six months. The coaccused Somesh Chavan having similar allegations has been released on bail. Hence, the Applicant is entitled for bail on principle of parity and requested to allow the Application.

It is contention of learned APP that the Applicant is main culprit who shot bullet in head of the deceased from pistol. The allegations against Somesh Chavan and the present Applicant are different. If Applicant released on bail, he may abscond or threaten prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The pistol used in the crime is recovered at the instance of the co-accused Somesh Chavan who has been released on bail. The allegations against the present Applicant and co-accused are similar. Hence, the Applicant is entitled for bail on principle of parity. 7.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Saurabh Roshan Amale be released on bail in Crime No.183 of 2022 registered with registered with

Warje Malwadi Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Court as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
