Learned counsel for the Applicant submits that considering the evidence on record, it cannot be said that any motive to kill the deceased can be attributed to the Applicant. In this regard he made reference to the statements of the witnesses. He further argued that the Applicant had lodged a report in respect of the same incident, in which he sustained injuries. He 1/2

13-ba2080-25.doc made reference to the injury certificate on record indicating cause of the injuries to the Applicant. He further submits that in any case it is not the case of the prosecution that the only the Applicant caused any assault on the deceased but allegation is against the co-accused too.
