By this application, the applicant is seeking regular bail in Crime No. 181 of 2024 registered with Baramati City Police Station, District Pune, for the offences punishable under Sections 307, 302, 120B, 143, 147, 148, 149, 323, 326, 504 and 506 of the Indian Penal Code 1860 (for short "IPC") and Section 135 of the Maharashtra Police Act. 2.

It is prosecution's case that on 17th March 2024, around 10.00 p.m., the applicant and co-accused assaulted the nephew of the first informant and murdered him.

It is contention of learned counsel for the applicant that the SHUBHADA SHANKAR KADAM co-accused, against whom similar allegations are levelled like the

applicant, is released on bail by this Court. The applicant is behind bar for more than 1 year and 10 months. Hence, the applicant is entitled for bail on principle of parity and requested to allow the application. 4.

It is the contention of learned APP that the allegations against co-accused-Vinod Dhotre and applicant are different. The allegation against the applicant is that he assaulted the deceased with iron bar, which is on higher footing, hence, requested to reject the application. 5.

I have heard both learned counsel, perused the charge-sheet and the documents produced on record. The allegations against the coaccused are that initially he and co-accused assaulted the deceased with wooden rod and thereafter the applicant assaulted the deceased with iron rod. The allegations levelled against applicant and co-accused-Vinod Dhotre are similar. The applicant is behind bar for more than 1 year and 10 months. Considering these facts, the applicant is entitled for bail on the ground of parity, hence, I pass the following order :

ORDER

(i) The applicant be enlarged on bail in Crime No. 181 of 2024 registered with Baramati City Police Station, District Pune, on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

(ii) The applicant shall attend the concerned police station as and

when required.

(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
