Heard Mr. Nikam, learned Advocate for the Applicant and Dr. Takalkar, learned APP for Respondent-State. 2.
Mr. Nikam, learned Advocate for the Applicant points out to the order dated 3rd January, 2025 passed in Criminal Bail Application No. 4157 of 2024 which reads as under : "1. The learned counsel for the applicant seeks leave to withdraw the present application with liberty to file fresh application for bail after four months, if the trial is not concluded by that time.

Considering the facts and circumstances of the case, the Trial Court shall make an endeavour to conclude the trial within a period of four months.

The application is disposed of as withdrawn with liberty as sought."

Mr. Nikam, learned Advocate for the Applicant submits that the trial is not concluded within the period as observed in the order dated 3rd January, 2025. He submits that the Applicant has not approached the trial court after the said period and has filed this Application before this Court. On instructions form the Applicant, he seeks leave to withdraw the present Bail Application with liberty to file the same before the learned Additional Sessions Judge, Niphad. Leave to withdraw granted with liberty as prayed. In the event, such application is filed before the learned Additional Sessions Judge, Niphad, the same shall be considered on its own merits and in accordance with law.

Criminal Bail Application No. 2123 of 2025 is dismissed as withdrawn with above said liberty.
