This is an application seeking interim bail on medical ground. By an order dated 11th November 2025, this Court had requested Ms. Poonam Bhosale, learned APP representing the State in the matter, to call for further health status report and essentially to bring on record the opinion of the Medical Authorities of Sir J.J. Group of Hospitals pertaining to requirement of replacement of steel implant in the left forearm of the Applicant.

Accordingly, Ms. Poonam Bhosale, learned APP appearing in the matter, has tendered on record, a copy of the report of the Department of Traumatology & Orthopaedic Surgery, Grant Medical College & Sir J.J. Group of Hospitals, Mumbai. The said Report is taken on record and marked 'X' for Identification.

Perusal of the Report indicates that the Applicant is an operated case of left sided Monteggia fracture and he complains of pain in the left elbow. According to the Medical Authorities of Sir J.J. Group of Hospitals, the Applicant needs surgery on a planned and elective basis, and not on an emergency basis. However, earlier reports in case of the Applicant, indicate that he is suffering from pain since the steel plate implanted in his left arm is broken and needs to be replaced.

In view of the aforesaid, I am inclined to grant interim bail to the Applicant for a period of two months. Accordingly, the authorities of the Taloja Central Prison, Navi Mumbai, are

directed to release the Applicant from the jail for a period of two months. The Applicant is directed to keep the Jail Authorities informed regarding his whereabouts and his medical details including, but not limited to the name of the Hospital in which he is proposed to be admitted and operated; name of the treating doctors; name and phone numbers of the family members/relatives visiting the Applicant and other such details, which may be required by the Jail Authorities/ Investigating Officer. On the expiry of the last day of the 2nd month of his release, the Applicant is directed to surrender before the authorities of the Taloja Central Prison, Navi Mumbai on or before 5 p.m.

Accordingly, the Bail Application is allowed in the aforesaid directions and disposed.
