After arguing the matter for some time, Ms. Megha Bajoria, learned APP, on instructions from the Investigating Officer, states that six witnesses have already been examined before the Trial Court and the prosecution intends to examine only 8 to 10 more witnesses.

Considering the statement made by Ms. Bajoria, Mr. Viral Mukte, learned counsel for the Applicant, seeks permission to withdraw the present Bail Application with 16th February 2026
24-BA-2146-2025.DOC liberty to file a fresh bail application if, within a period of six months, the Trial Court has not substantially progressed. 3.
Since five witnesses are already examined and only few witnesses remain to be examined, the Trial Court is requested to expedite the trial and in any case, conclude the same within a period of six months from the date on which this order is produced before it.

Permission to withdraw with the aforesaid liberty is granted.

The Bail Application is accordingly disposed of as withdrawn.
