By the present Application, the Applicant is seeking bail in Special Case No. 306 of 2022 in connection with Crime No. 18 of 2022 registered with Vadgaon Maval Police Station, Pune, for the offence punishable under Section 376(2)(n), 506 of the Indian Penal Code and Section 4, 5(j)(ii), (p), 8, 12 of POCSO Act.

Present Application is premised on the liberty granted in Bail Application No. 2989 of 2023 by order dated 3rd April, 2024. 4.
Mr. Khan, learned APP on instructions from the Investigating Officer states that the Statement of the Accused under section 313 of the Code of Criminal Procedure (Section 351 of the BNSS) has been recorded.

Ms. Sana Khan, learned Advocate for the Applicant states that the Applicant has filed Application dated 5th May, 2025 before the Trial Court, seeking recall of the witnesses, for the reasons mentioned in the said Application.

In view of the above, Ms. Sana Khan, learned Advocate for the Applicant on instructions from the Applicant states that she has instructions to withdraw the present Application. She submits that fresh bail Application will be filed before the learned Trial Court. Statement made by Ms. Sana Khan, learned Advocate for the Applicant seeking withdrawal of the present Bail Application is accepted. Leave granted.

In the event, any application is filed by the Applicant before the learned Trial Court, the same be considered on its own merits and in accordance with law.
