After hearing counsel for both sides and when this Court has shown dis-inclination to grant any relief to the Applicant at this stage, learned counsel for the Applicant on instructions seeks withdrawal of the Application with liberty to file fresh application in case there is no progress in the trial within a period of six months from today.

Learned APP on instructions makes statement that about 10 to 12 witnesses are to be examined before the Trial 1/2
