By these Applications, the Applicants seek bail in Crime No. 708 of 2024 registered with Pandharpur City Police Station, District - Solapur for the ofence punishable under Sections 318 (1), 318 (4), 336 (1), 336 (3), 338, 340 (2), 3 (5) of Bharatiya Nyaya Sanhita.

Prosecution case, in short, is that, the informant Smt. Harshada Hemant Shukla is the owner of land Gut No. 119/4/69 ad measuring 278.85 sqare meters at village Isbhavi, Taluka - Pandharpur, District - Solapur. The said Plot was purchased by her husband from one Shivaji Tukaram Korake. Thereafter, the husband of the informant died. She resides at Gandhi Road, Pandharpur. After the death of her husband, she never visited the said land. In October, 2024 when she visited the plot, she came to know that a ive storied building is constructed on the said plot. On inquiry she came to know that Applicant Saraswati Masu Mane had purchased the said plot from a dummy person on 30.06.2022. For this forged Aadhar cards, PAN cards and other documents were prepared. Thereafter, Accused Saraswati Mane sold the said plot to Raju Vitthal Khandale on 26th August, 2022. Raju Khandale constructed building on the said plot. Hence, the FIR is lodged.

Learned Advocates for the Applicants submit that the Applicants are arrested on 24th April, 2025 and 26th November 2024. Investigation is complete and they are behind the bars since then. Charge sheet is iled, however, charge is yet not framed. The Applicants being women, they may be released on bail.

Learned APP and learned Advocate for the informant have strenuously opposed the Applications stating that the Applicants have impersonated the informant and their participation in the crime is revealed in the investigation. Since the Applicants have committed serious ofence, they are not entitled for bail. 5.

Taking into consideration the gender of the Applicants and the fact that charge sheet is iled in the year 2024 and though the matter is numbered as RCC No. 192 of 2025, till date, even charge is not framed against the Accused persons, the trial is not not likely conclude in the near future, the Applicants are entitled for bail.

In the result, following order:

ORDER

A.

Bail Applications are allowed.

B.

The Applicants be released on bail in connection with the

{4} Crime No. 708 of 2024 registered with Pandharpur City Police Station, District - Solapur for the ofence punishable under Sections 318 (1), 318 (4), 336 (1), 336 (3), 338, 340 (2), 3 (5) of Bharatiya Nyaya Sanhita, on their executing Personal Bond of Rs.15,000/- each with one surety each in the like amount.

C.

The Applicants shall not tamper the prosecution evidence. They shall attend the trial regularly.
