Heard Ms. Ashwini Achari, learned Advocate for the Applicant and Ms. Anamika Malhotra, learned A.P.P. for the State/Respondent.

This matter was heard on 30th June 2025. At the request of the parties, the matter was fixed today for verification of the antecedents of Applicant and the consequences of same with reference to the provisions of Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Ms. Ashwini Achari, learned Advocate for the Applicant states that though the prosecution has alleged the Applicant having three criminal antecedents, there is no clarity about the said criminal Gitalaxmi

908-BA-2251-2025.doc antecedents atleast on record. She therefore disputes the Applicant having any criminal antecedent, as alleged.

Ms. Anamika Malhotra, learned A.P.P. for the State/Respondent submits that if there is a dispute raised by the Applicant, then the State/Respondent would file a Affidavit-inReply for the limited purpose of placing on record details of the said three criminal antecedents of the Applicant, as were referred by her on 30th June 2025. She prays for two weeks' time to file said Affidavit-in-Reply.

Ms. Ashwini Achari, learned Advocate does not object for grant of time.

In view of the request made by Ms. Anamika Malhotra, learned A.P.P. and by consent of the parties, list the matter on 18th July 2025.
