By this Application, Applicant is seeking regular bail in Crime No.291 of 2024 registered with Pawarwadi Police Station, Nashik, for the offences punishable under Sections 109, 118(1), 118(2), 351(2), 351(3), 352, 3(5) of the Bhartiya Nyaya Sanhita ('BNS' for short) and Sections 4 and 25 of the Arms Act.

It is prosecution's case that on 29th December 2024 at around 8.00 p.m., the Applicant and co-accused assaulted the brother of the first informant with sharp weapon with an intention to kill him.

It is contention of learned counsel for the Applicant that the Applicant that the Applicant is behind bar for around one year. The coaccused having similar allegations is released on bail. Hence, the Applicant is entitled for bail on principle of parity. The Applicant has no antecedents and the injury caused to the victim is not on a vital part of the body and requested to allow the Application.

It is contention of learned APP that the Applicant assaulted injured with a sharp weapon on his hand with an intention to kill him. Due to said assault, left hand's finger of injured is cut. If the Applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the Application.

I have heard all learned counsel. Perused charge-sheet and documents produced on record.

The Applicant has no antecedent. The co-accused Nadeem having similar allegations has been released on bail. Hence the Applicant is entitled for bail on the principle of parity. 7.
Considering these facts, I pass following order.
ORDER
(i) The Applicant-Karim Ahmad Muneer Ahmad be released on bail in Crime No.291 of 2024 registered with
Pawarwadi Police Station, Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall give attendance before the Investigating Officer once a month on first Monday of the month, till framing of the charge.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
