Heard Mr. Aniket Vagal, learned Advocate for the Applicant and Mr. P. H. Gaikwad, learned APP for the State. 2.

By the present bail application, the Applicant has sought for the following relief:

"a) That this Hon'ble Court may kindly enlarge the Applicant on bail in connection with FIR bearing C.R. No.802/2021 dated 16.9.2021 registered with Kondhwa Police Station, Pune for allegedly having committed the offences punishable under Section 302, 120(b), 307, 326, 324, 323, 141, 143, 144, 147, 149 read with 34 of the Indian Penal Code (in short IPC), Section 37 (1) 135 of Maharashtra Police Act, Section 4 (25) of Arms Act, Section 7 of Criminal Law Amendment Act and Section 3 (1) (1), 3(2) and 3 (4) of Maharashtra Control of Organized Crime Act, 1999 (in short MCOC Act)." 3.

Exhibit D, at page No.527, is an order dated 04.07.2024 passed by this Court in Bail Application No.2183 of 2024 filed by the present Applicant. Order dated 04.07.2024 reads as under:

Learned counsel for Applicant on instructions seeks permission to withdraw present application. Permission is granted. The application is disposed off as withdrawn."

Exhibit-E, at page No.528 of the paper book is an order dated 08.04.2025 passed by this Court in Bail Application No.3119 of 2025, filed by the Applicant. Order dated 08.04.2025 reads as under:

"1.

Learned APP for the respondent/State has drawn my attention to the order passed by this Court dated 4.7.2024 in Criminal Bail Application No.2183 of 2024 filed by the present applicant. The said order reads thus:

"Learned counsel for Applicant on instructions seeks permission to withdraw the present application. Permission is granted. The application is disposed off as withdrawn."

Learned counsel for the applicant submits that the application was not argued on merits and it was simplicitor withdrawn. If this is so, then liberty ought to have been sought to file fresh application. In absence of such liberty, I am not inclined to entertain the present application. The Application is rejected."

After hearing the matter for substantial time and upon the said orders being pointed out, Mr. Aniket Vagal, learned Advocate for the Applicant and he being questioned about the maintainability of the present bail application, Mr. Aniket Vagal on instructions from the Applicant, seeks leave to unconditionally withdraw the present Bail Application No.2321 of 2025. Statement of Mr. Aniket Vagal is accepted. Leave as prayed for is granted. 6.

In view of the above, Bail Application No.2321 of 2025 is dismissed as unconditionally withdrawn.
