By this application, the Applicant seeks regular bail in connection with Crime No.1608 of 2024 registered with Karad City Police Station, District: Karad, for the offences punishable under Sections 406 and 420 of the Indian Penal Code, 1860 (for short, "IPC") and Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999. 2.

The prosecution case is that the informant and others have given amount to the Applicant for investing the same in the share market. The Applicant assured that to give double returns in one year.

However, the Applicant failed to give the returns as assured and hence, he has cheated the informant and others. 3.

Heard learned advocate for the Applicant and learned APP for Respondent - State instructed by Investigating Officer. 4.

It is the case of the Applicant that he has entered into an agreement with the informant and others that they have given him hand loan of the amount given by them for investing in the share market. He had also given cheques to them and some of them have already lodged Section 138 proceedings against him as the cheques given by him are dishonoured.

The Applicant is arrested on 28th January, 2025 and chargesheet in the present crime is filed on 28th March, 2025. 19 witnesses are cited in the charge-sheet. The trial is not likely to conclude in near future. In these facts, the Applicant cannot be punished by pre-trial detention.

In the result, the application is allowed.

The Applicant - Pramod Ramesh Patil be released on bail in connection with Crime No.1608 of 2024 registered with Karad City Police Station, District: Karad, on executing Personal Bond of Rs.1,00,000/- with one or more sureties in the like amount.

The Applicant shall report to the concerned police station twice in a month on first and last Sunday of every month between 10:00 a.m. to 12:00 p.m. till conclusion of the trial. 9.

The Applicant shall not tamper the prosecution evidence. (NITIN B. SURYAWANSHI, J.)
