Learned Advocate for the Applicant is seeking bail in connection with C.R. No.108 of 2023 registered with Mumbai Naka Police Station, Nashik, which is now registered as Special Case No.154 of 2023.

Mr. Vinod Chate, learned APP points out to the order dated 22.04.2024 passed by this Court in Bail Application No.3756 of 2023 dismissing the Bail Application filed by the Applicant, on merits. He further submits that the said order has been maintained by the Hon'ble Supreme Court.

Mr. K. N. Shermale, learned Advocate for the Applicant faced

7-ba-2363-2025.doc with this situation, on instructions, from the Applicant states that the Applicant be permitted to withdraw the present bail application with liberty to file a fresh bail application before the learned Sessions Judge, in view of the change in circumstances, which according to him, are co-accused being granted bail on the ground of long incarceration. Leave granted to withdraw the present application with liberty.

In the event, a fresh application is filed by the Applicant before the learned Sessions Court, the learned Sessions Court to consider the same on its own merits and in accordance with law on the grounds as may be raised by the Applicant. The Additional Sessions Judge shall endeavor to decide such application expeditiously.

In view of the above, Bail Application No.2363 of 2025 is dismissed as withdrawn with the liberty as above. (ASHWIN D. BHOBE. J.)
