Heard Mr. Priyal G. Sarda, learned Advocate for the Applicant and Mr. Pandurang H. Gaikwad, learned A.P.P. for the State/Respondent.

By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 52 of 2018 registered with Khopoli Police Station, Raigad for the offence punishable under Sections 302 and 120(B) read with 34 of the Indian Penal Code Act, 1860 ("IPC" for short). 3.
Mr. Priyal Sarda, learned Advocate for the Applicant submits that the abovesaid crime is registered as Sessions Case No. 397 of
2019, which is pending on the file of Additional Sessions Judge, Panvel, District-Raigad.

There are 8 accused in the said crime. Applicant is Accused No. 1.

Criminal Bail Application No. 88 of 2024 filed by the Applicant was rejected by this Court vide order dated 8th August 2024.

The Investigating Officer (Senior Inspector), Mr. S. V. Raut attached to Khopoli Police Station is present in the Court. Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent on instructions from the Senior Inspector states that the trial would be positively completed within a period of 3 months from 1st July 2025.

In view of the statement made by the Senior Inspector, Khopoli Police Station, who is present in the Court, Mr. Priyal Sarda, learned Advocate on instructions from the Applicant seeks leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Trial Court on the ground of long incarceration, if the trial is not completed within a period of 3 months from 1st July 2025. Leave as prayed for is granted. In the event, any Bail Application is filed by the Applicant before the learned Trial Court, such Application shall be considered on its own merits and in accordance with law.

In view of the above, Criminal Bail Application No. 2440 of 2025 is dismissed as withdrawn with liberty as prayed.
