Heard Mr. Aditya Parmar, learned Advocate for the Applicants and Dr. Ashvini Takalkar, learned APP for the State. 2.

By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicants are seeking regular bail in Crime No. 325 of 2021 registered with Chaturshringi Police Station, Pune for offences punishable under Section 307, 386, 341, 141, 143, 147, 148, 149 of the Indian Penal Code, Section 3, 25 of Arms Act, Section 37(1), 37(3), 135 of the Maharashtra Police Act and Section 39 of Money Lending Act alongwith Section 3(1) (ii), 3(2), 3(3), 3(4), 3(5), 5 of

Maharashtra Control of Organized Crimes Act.

Mr. Parmar, learned Advocate for the Applicants states that Bail Applications at Exh. 183 and Exh. 239 in MCOCA Case No. 29 of 2022 filed by the Applicants are pending before the learned Special Judge under MCOCA, Pune. He states that the Applicants would be satisfied if the learned Special Judge under MCOCA, Pune is directed to consider the aforesaid Bail Applications which are pending from the the year 2024. 4.

Dr. Takalkar, learned APP submits that pending two bail applications before the learned Trial Court, the Applicants were not entitled to move the present Application. 5.

Be that as it may, since Bail Capitations at pages 169 and 199 are pending before the learned Special Judge under MCOCA, Pune, it would be appropriate if the said Applications are considered and decided by the learned Special Judge under MCOCA, Pune.

In view of the above, the learned Special Judge under MCOCA, Pune is requested to dispose of the two bail applications at Exh. 183 and Ex. 239 on the file of MCOCA Case No. 29 of 2022, expeditiously and preferably within four weeks from today. 7.

In view of the above, learned Advocate for the Applicants

on instructions from the Applicant states that present Criminal Bail Application is not pressed for.
