Today at 6.45 p.m. before rising, Mr. Abid Mulani, learned Advocate for the Applicant-Mr. Aditya Avinash Sood appeared on Video Conference and moved a praecipe of today's date seeking urgent listing of an Interim Application. Urgency pleaded is that the father of Applicant has passed away today and therefore, the Applicant is seeking interim bail for a period of 3 days for attending rituals of his late father.

In view of the urgency expressed by Mr. Abid Mulani, learned Advocate, place the matter before me at 6.55 p.m. 3.

Mr. Abid Mulani, learned Advocate for the Applicant to inform Mr. Shishir Hiray, learned Spl.P.P. for the State/Respondent

and learned Advocate appearing on behalf of the Intervenor. Email services is permitted. At 6.55 p.m. :

By the present Application, the Applicant is seeking the following relief :- "(a) Pending the final hearing and disposal of the main Bail Application, the present Applicant/Accused No. 8 may kindly be released on interim bail for a period of three (3) days in connection with Special Case No. 917 of 2025 arising out of FIR bearing C.R. No. 306 of 2024 registered with Yerwada Police Station, Pune on such terms and conditions as this Hon'ble Court may deem fit and proper in the interest of justice." 5.

In support of the said prayer, the Applicant has made the following averments in paragraph no. 5 of the praecipe :- "5.

The Applicant is constrained to file the present Interim Application seeking interim bail pending the final hearing and disposal of the main regular Bail Application, in light of a medical emergency concerning his 92 year old father. On 28.07.2025, the Applicant's father suffered a major/severe heart attack and has since been hospitalised.

However, due to persistent fluctuations in his blood pressure, the treating doctors have not yet been able to schedule the angioplasty surgery, and the senior citizen continues to remain under close observation in the Intensive Care Unit (ICU). The Applicant, aged 53 years, has no criminal antecedents and is the only

adult male member in the family. In these exceptional and compassionate circumstances, the Applicant is urgently required to be present with his family. The Applicant's father is declared died at around 5:30 p.m. today and therefore, the Applicant prays that he be released on interim bail for a period of three (3) days."

Mr. Abid Mulani, learned Advocate for the Applicant submits that the Applicant is seeking interim bail from 2nd August 2025 till 12.00 noon of Tuesday, i.e., 5th August 2025. He submits that the interim bail is on account of the death of Applicant's father. He submits that he has instructions from the Applicant to give an undertaking that the Applicant will surrender on 5th August 2025 before the Jail Authorities on or before 12.00 noon. He submits that an undertaking from the Applicant to that effect will be filed upon his release from jail by Monday, i.e. 4th August 2025. Statement made by Mr. Abid Mulani, learned Advocate, is accepted as a statement to the Court.

Mr. Shishir Hiray, learned Spl.P.P. for the State/Respondent submits that he has no objection if the Applicant is granted interim bail for a limited period from 2nd August 2025 till 12.00 noon of 5th August 2025.

In view of the above, the praecipe is allowed on the following conditions :- a.

Applicant to furnish P.R. Bond in the sum of Rs. 25,000/- (Rupees Twenty-five Thousand Only) with cash surety in the like amount.

b.

Applicant shall surrender to the Jail Authorities by 12.00 noon of 5th August 2025.

This order will be digitally signed by the Private Secretary/Personal Assistant of this Court. All concerned will act order.

Mr. Abid Mulani, learned Advocate for the Applicant submits copy and ensure the Applicant is released at the earliest on 2nd August 2025, so that the Applicant can attend the rituals. Jail Authorities to take note of the submission and expedite the release of the Applicant.
