By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicants are before this Court seeking regular bail in connection with Crime No. 725 of 2024 registered with Daund Police Station, District-Pune Rural for the offences punishable under Section 310(2) of the Bharatiya Nyaya Sanhita, 2023 ("BNS" for short).

Mr. Pranav Bhoite, learned Advocate for the Applicants submits that the abovesaid crime is registered as Sessions Case No. 85 of 2025 and is pending on the file of Additional Sessions Judge, Baramati.

There are 5 accused persons in the present crime. Applicant (Aniket Raju Labade) in Criminal Bail Application No. 2490 of 2025 is Accused No. 1, whereas Applicant (Bablu Govind Kamble) in Criminal Bail Application No. 2473 of 2025 is Accused No. 4. 5.
Case of the prosecution is that on 27th September 2024 at about 1.00 a.m. near Sonwadi Railway Bridge in the vicinity of village, Daund Narendrasing Tawar was driving truck bearing no. RJ-23-GC-2507 and Subhashchand Mulchand Yadav was sleeping in the cabin. At that time, 5 unknown persons stopped the said truck by showing knife and robbed cash amount of Rs. 56,000/- as also a Vivo Mobile.

Applicant (Accused No. 1) was arrested on 10th October 2024, since then he is in jail. Criminal Bail Application No. 82 of 2025 filed by the Applicant was rejected by the learned Additional Sessions Judge, Baramati by order dated 21st March 2025. 7.
Applicant (Accused No. 4) was arrested on 14th October 2024, since then he is in jail. Criminal Bail Application No. 105 of 2025 filed by the Applicant was rejected by the learned Additional Sessions Judge, Baramati by order dated 24th March 2025. 8.
Mr. Pranav Bhoite, learned Advocate for the Applicants submits that in the entire charge-sheet, there is no material or any
evidence to implicate or show the involvement of the Applicants in the crime bearing No. 725 of 2024. He submits that apparently the Applicants have been arrested on the basis of mere suspicion, i.e., the Applicants having criminal antecedents of similar nature. He submits that in the absence of any material or evidence on record indicating the involvement of Applicants in the present crime, detention of the Applicants is not warranted. 9.
Ms. Veera Shinde, learned A.P.P. for the State/Respondent submits that the Applicants have been arrested on the basis of their past criminal antecedents. She submits that there is no material on record to indicate the involvement of Applicants in the offence, which is registered as Crime No. 725 of 2024. 10.
I have perused the records with the assistance of learned Advocates of the parties.

Considering the submissions made by Ms. Veera Shinde, learned A.P.P. for the State/Respondent to the effect that there is no material on record to indicate the involvement of Applicants in Crime No. 725 of 2024 and further the fact of Applicants not even being named in the First Information Report, Mr. Pranav Bhoite, learned Advocate for the Applicants would be justified in his submissions that there is no need for detention of the Applicants in the present crime.

In view of the above and in absence of any material on record to indicate the involvement of the Applicants in the present crime, the Applicants are entitled to bail. Hence, the present Bail Application is allowed on the following conditions :-
a.
Applicants are directed to be released on bail in connection with Crime No. 725 of 2024 registered with Daund Police Station, District-Pune Rural for the offences punishable under Section 310(2) of the BNS on executing P.R. Bond in the sum of Rs. 25,000/- (Rupees Twenty-five Thousand Only) each with one or two sureties in the like amount to the satisfaction of the Additional Sessions Judge, Baramati.
b.
Applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of accusation, so as to dissuade him from disclosing such facts to the Court or to any police officer.
c.
Applicants shall not tamper with the prosecution witnesses and evidence in any manner.
d.
Applicants upon their release, within a period of three days from their release, shall furnish their cell phone numbers and residential addresses with proof to the Investigating Officer, Daund Police Station, DistrictPune Rural and shall keep the same updated, in case of any change thereto.
e.
Applicants shall co-operate in the conduct of the trial of Sessions Case No. 85 of 2025 and shall regularly attend the hearing of the case pending on the file of Additional Sessions Judge, Baramati, on each and every date, unless exempted from appearance.
