Heard learned Counsel for both the sides.

Learned Counsel for the Applicant submits that there were in all four persons working with the father of the victim, aged about 5 years. It is his submission that one of them is said to have sexually assaulted the victim. According to him, there is no evidence in order to connect the present Applicant with the crime in question. This submission is based upon the fact that even in identification parade the victim does not identified the Applicant to be perpetrator of the crime but simply identified him to be one of the person calling him as "Bhaiyya". It is submitted that in absence of any such evidence, the Applicant who is aged about 19 years old, is entitled for the bail 6th April, 2026

Learned APP and learned Counsel for the Respondent No.2 opposes the application pointing out the serious nature of the crime. Learned APP drew attention of the Court to the statements of witnesses indicating Extra Judicial Confession being made by the Applicant to these witnesses. It is submitted that no order be passed of granting bail till the victim is examined before the Trial Court. Learned APP seeks time to make statement as to the period within which the victim to be examined before the Trial court.
