Heard Ms. Priyanka R. Mehta, learned Advocate for the Applicant and Mr. Amit Palkar, learned APP for the State. 2.

By the present application, Applicant is seeking bail in connection C. R. 156 of 2025 lodged with Sangavi Police Station, Pimpri-Chinchawad.

Ms. Priyanka R. Mehta, learned Advocate for the Applicant submits that the bail application filed by the Applicant was decided prior to the filing of the charge-sheet. She submits that after the order dated 06.06.2025 passed by the Trial Court, prosecution has filed the charge-sheet in the above said crime. She submits that the charge-sheet was filed on 18.07.2025.

In view of the filing of the charge-sheet, Ms. Priyanka R. Mehta, on instructions from the Applicant, craves leave to

51-ba-2505-2025.doc withdraw the present bail application to file a fresh bail application before the learned Trial Court, in view of the change in circumstances.

Mr. A. A. Palkar, learned APP does not object to the withdrawal and the course suggested by the learned Advocate for the Applicant.

In view of the above, Applicant is permitted to withdraw the present bail application with liberty to file a fresh bail application before the Trial Court. If such application is filed, the learned Trial Court shall consider the application on its own merits and in accordance with law.

In view of the above, Bail Application No.2505 of 2025, dismissed as withdrawn with liberty as prayed. (ASHWIN D. BHOBE. J.)
