By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicant is seeking regular bail in Crime No. 42 of 2024 registered at Mandwa Coastal Police Station for offence punishable under Section 302 of the Indian Penal Code.

Bail Application at Exh. 6 filed by the Applicant in Sessions Case No. 19 of 2024 was dismissed by the learned Additional Sessions Judge, Alibag, Raigad by order dated 30th November, 2024.

After having heard the matter for some time, Mr. Arote, learned Advocate for the Applicant on instructions of the Applicant seeks leave to withdraw the present Bail Application with liberty to file a fresh application before the learned Trial Court in the event, there are change in circumstances. Leave granted. 5.

In the event, there are change in circumstances, the Applicant is at liberty to file a fresh bail application before the learned Trial Court. In the event, any such application is filed by the Applicant before the learned Trial Court, the same be decided on its own merits and in accordance with law. 6.

In view of the above, Criminal Bail Application No. 2513 of 2025 is dismissed as withdrawn.
