By the present Application, the Applicant is seeking bail pending the hearing and final disposal of the Spl. Case No. 53 of 2022 in connection to DRI/MZU/C/INT - 84/2021 registered at the instance of the Directorate of Revenue Intelligence, Mumbai Zonal Unit, Mumbai. 2.

Mr. Saket Ketkar, learned Advocate for Respondent No. 1 points out to the Order dated 12.02.2025 passed by this Court in B. A. No. 62 of 2024 wherein the Applicant was granted liberty to apply a fresh, after six months. He submits that the present Application is filed before the expiry of six months. He submits that such liberty will have to be availed before the learned Trial Court, at the first instance. Anand

Mr. Pereira, learned Advocate for the Applicant sought a pass over to take instructions. After some time, the matter was mentioned. Mr. Pereira, on instructions, from the Applicant craves leave to withdraw the present Bail Application to file an appropriate/fresh Bail Application before the learned Trial Court in terms of the liberty granted by this Court by Order dated 12.02.2025 passed in B. A. No. 62 of 2024. Leave as prayed for is granted. If such Application is filed by the Applicant, the same shall be considered on its own merits and in accordance with law. Considering the observations made by this Court in the Order dated 12.02.2025, if an Application for bail is filed by the Applicant, learned Additional Sessions Judge, Panvel to make an endeavour to decide the said Application expeditiously. 4.

Bail Application No. 2516 of 2025 dismissed as withdrawn with liberty as above.
