Heard. Mr. Tanmay Kate, learned Advocate for the Applicant submits that amongst other grounds, the Applicant is praying for bail on the ground of long incarceration. He submits that the Applicant was arrested on 24th February, 2018 and since then he is in jail except for the period from 27th March, 2022 till 22nd May, 2023 when he was released on temporary bail. He submits that though the charge is framed in the year 2021, trial has not proceeded and no witnesses have been examined in the said proceedings bearing Sessions Case No. 262 of 2022 pending on the file of the learned Additional Sessions Judge, Vadgaon Maval, Dist. Pune.

Mr. Gaikwad, learned APP waives service of notice on behalf of State and submits that during the pendency of the temporary bail granted to the Applicant, the Applicant was involved in Crime No. 49 of 2023. He further submits that the records indicate that the Applicant is responsible for causing delay in trial. He states that a short reply needs to be filed and seeks time to file reply.
