By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 266 of 2025 registered with Sinhgad Road Police Station, District-Pune City for the offences punishable under Sections 8(c), 20(b) & 20(b)(ii) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ("NDPS" for short). 3.

Mr. Shantanu Kolhe, learned Advocate for the Applicant has circulated a praecipe of today's date seeking withdrawal of the Gitalaxmi

502-BA-2567-2025.doc present Bail Application. Said praecipe is taken on record and marked as "X" for identification. He submits that the Applicant intents to file a fresh Bail Application before the learned Special Court under the NDPS Act at Pune, in view of the change in circumstances arising upon filing of the charge-sheet. He therefore seeks withdrawal of the present Bail Application. 4.

Ms. Anamika Malhotra, learned A.P.P. for the State/Respondent does not object to grant of the request made by Mr. Shantanu Kolhe, learned Advocate for the Applicant. 5.

In view of the statement made by Mr. Shantanu Kolhe, learned Advocate for the Applicant, leave granted to withdraw the present Bail Application with liberty as prayed. If any such Bail Application is filed by the Applicant before the learned Trial Court, then the same shall be considered on its own merits and in accordance with law.
