By this application, the applicant is seeking regular bail in C.R.No. 120 of 2023 registered with Bhosari Police Station, PimpriChinchwad, Pune for the offence punishable under Sections 420, 406 and 409 of Indian Penal Code, 1860 (for short "IPC") read with Section 3 of Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 (for short "MPID Act"). 2.
It is prosecution's case that applicant cheated the first informant and other investors by inducing them to invest the amount in his company with assurance that he will return it with handsome returns on it. It is alleged that applicant did not return the said amount nor gave any returns on it.

It is contention of learned counsel for the applicant that applicant was released on bail by this Court, but he was rearrested on the ground that he violated the conditions imposed by this Court, by not attending the Trial Court dates regularly. The applicant undertakes to attend the dates of Trial Court regularly and requested to allow the application.

It is contention of learned APP that the applicant has violated the condition imposed by this Court. Hence, requested to reject this application.

I have heard both the learned counsel. The applicant was already released on bail by this Court. He has been rearrested, he violated the condition imposed by this Court. The applicant undertakes to obey the condition and attend the Court dates regularly. Considering the said fact, I pass following order.
ORDER
i.
The Applicant - Santosh Jaysingh Pawar be released on bail in connection with C.R.No. 120 of 2023 registered with Bhosari Police Station, Pimpri-Chinchwad, Pune, on his furnishing P.R.Bond of Rs.25,000/- with one or two local solvent sureties in the like amount.
ii.
The Applicant shall not tamper with the prosecution
evidence and shall not contact or influence the Complainant or any witness in any manner.
iii.
The Applicant shall attend the trial regularly and shall not seek unnecessary adjournments.

The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.
7.
It is clarified that the observations made herein are prima facie and the Trial Court shall decide the case on its merits, uninfluenced by the observations made in this order.
