Heard learned counsel for the Applicant and learned APP for the State.

By this application, the applicant is seeking regular bail in Crime No. 1689 of 2023 registered with Hadapsar Police Station, for the offence punishable under Sections 406 & 420 of the Indian Penal Code, 1860 ('IPC').

It is prosecution's case that Applicant is the owner of 'Deccan Nandini Holidays'. He took the amount from first informant and other customers on the ground that he will arrange their tour in abroad, will exchange their amount in dollars and duped to Rs.79 lacs. 4.
It is contention of learned counsel for the Applicant that
due to unavoidable circumstances, Applicant could not arrange the tour as assured he is returning the amount to the customers. To show bonafide, Applicant has deposited Rs.5 lacs before the trial Court. He has no antecedents. Applicant is behind bars around one year and nine months. There is no progress in the trial and requested to allow the application. 5.
It is contention of learned APP that applicant took the amount from first informant and customers on the ground of arranging tour of them and exchanging of foreign currencies. If Applicant is released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

Applicant is behind bars around one year and nine months. There is no progress in the trial. Applicant has no antecedents. To show bonafide, Applicant has deposited Rs.5 lacs before the trial Court. It may take time to conclude the trial.

Considering these facts, I pass following order:
ORDER
(i) The Applicant-Milind Madhukar Joshi be released on bail in
Crime No. 1689 of 2023 registered with Hadapsar Police Station, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned police station, as and when required.
(v) Bail Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
