Heard learned counsel for the Applicant, learned APP for the State and learned counsel for Respondent No.2. 2.
By this Application, the Applicant is seeking regular bail in Crime No. 267/2023 dated 24/06/2023 registered with Ghodegaon Police Station, Dist. Pune for the offences punishable under Sections 376(D), 323, 504, 506 r/w. 34 of the Indian Penal Code. 3.
It is prosecution's case that on 23/06/2023 around 9.30 to 10.30 p.m., Applicant and co-accused sexually assaulted the first informant by taking turns.

It is contention of learned counsel for the Applicant that Applicant is behind bars more than 2 years and 7 months. The
prosecution has examined first informant/victim before the trial Court. She has turned hostile. She has not stated anything against the Applicant and requested to allow the Application.

It is contention of learned APP and learned counsel for Respondent No.2 that Applicant and co-accused gang raped the first informant. The trial is in progress. If Applicant released on bail, he may abscond and requested to reject the Application. 6.
I have heard all learned counsel. Perused charge-sheet and documents produced on record.

Though there are allegations against the Applicant and coaccused of gang rape, in evidence before the trial Court, the first informant has turned hostile. Applicant is behind bars more than 2 years and 7 months.

Considering these facts, I pass following order.
ORDER
(i) The Applicant- Adesh Ashok Jadhav be released on bail in Crime No. 267/2023 dated 24/06/2023 registered with Ghodegaon Police Station, Dist. Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
