Heard Ms. Suvarna Yadav, learned counsel for the Applicant, Mr. A. A. Palkar, learned APP for the State and Mr. Amit Singh, learned Advocate appointed under the Legal Aid Scheme. 2.
By the present Application, Applicant is seeking bail in connection with Crime No.274 of 2020 registered with Chiplun, Police Station District Ratnagiri.

In view of the medical urgency, notice was issued on 23rd July,

Ms. Suvarna Yadav has placed on record the medical papers of the Applicant i.e. the photostat copy of the follow-up case papers issued by the Prakash Hospital & Research Centre, Urun-Islampur, which contains the following endorsement. "Advice : Coronary Angioplasty next Saturday 26th July, 2025" same is taken on record and marked 'X' for identification.

In view of the above, this matter is taken out of turn and the request of the Applicant is being considered in terms of prayer clause 1(c) of the Application.

Ms. Suvarna Yadav points out to the order dated 7th April, 2025 passed in Special Case No.1 of 2021 at Exhibit-534, by which the Applicant was released on Interim Bail, considering the medical ground placed on record by the Applicant. Said order is at pages 326 till 332 of the paper book.

Ms. Suvarna Yadav, on instructions from the Applicant state that the medical ground as placed before this Court is genuine and the Applicant has to undergo the angioplasty as suggested at the earliest and preferably on 26th July, 2025 as adviced by the doctors. It is on the basis of the said representation made by Ms. Suvarna Yadav, learned Advocate for the Applicant and considering the Applicant was granted interim bail by the learned Special Court Chiplun by its order dated 7th April, 2025 for a period of 45 days, which was extended up to 21st July, 2025, that the request of the Applicant for interim bail is considered. 7.
In view of the above Applicant is granted interim bail for a limited period of 45 days commencing from 26th July, 2025. Applicant is enlarge on interim bail so as to enable him to avail medical treatment. 8.
Ms. Suvarna Yadav on behalf of the Applicant states that, Applicant shall surrender before the jail authorities upon the expiry of the period of interim bail.

Interim Bail is granted on the following conditions :- (a) Applicant shall be released on interim bail for a limited period of 45 days from 25th July, 2025, on furnishing personal bond of Rs. 25,000/- with one or two sureties in the like amount.
(b) Applicant shall furnish the details and particulars of his medical treatment, before this Court on or before the next date in the present matter.
(c) Applicant shall surrender before the jail authorities before the expiry of the period of 45 days from today (i.e. on 25th July, 2025).
(d) Applicant shall not interfere with the prosecution witness and shall not tamper with evidence.

Ms. Suvarna Yadav submits that the Applicant be permitted to give cash surety in lieu of sureties. She undertakes to furnish regular sureties within 2 weeks of the treatment of the Applicant. Applicant is permitted to furnish provisional cash surety. 11.
Ms. Suvarna Yadav shall furnish the required documents / spare paper book for the purpose of service on the Respondent No.2. The documents be furnished by the end of the day. Said document/spare paper book be served upon the Respondent No.2 at the address mentioned in the cause title through the Investigation Officer. 12.
