The present bail application is filed by the applicant mainly on the ground that there has been delay in conclusion of the trial. 2.

However, it is observed that in most bail applications filed on such ground, certain basic procedural requirements are not followed, such as:

(i) Certified copy of the roznama (i.e., the daily court proceedings) is not attached;

(ii) Either the complete charge-sheet or relevant parts thereof are not annexed;

(iii) The application does not disclose whether the applicant has any past criminal antecedents;

(iv) It is also not stated whether any earlier bail application has been filed before this Court.

Moreover, in many cases, the orders passed by the Sessions Court rejecting earlier bail applications are also not placed on record.

In view of the above deficiencies, and to ensure uniformity and procedural compliance, the following directions are issued for all regular bail applications filed before this Court (Coram: Amit Borkar, J.):

The office shall not accept any new regular bail application unless it satisfies the following requirements: (i) If the charge-sheet has been filed, a copy of the entire charge-sheet must be annexed.

(ii) A clear statement must be made that no bail application filed by the applicant is pending before this Court, the Trial Court, or any other Court.

(iii) Where bail is sought on the ground of delay in trial, a certified copy of the roznama, or a copy downloaded from the eCourts website, must be annexed.

Every bail application must also include a specific statement as to:

(i) Whether any prior bail application has been filed before this Court or any other Court;

(ii) If yes, copies of all orders passed in such applications

must be annexed.

Applicants shall also annex all orders passed by the Trial Court in respect of earlier bail applications, and not merely the last order of rejection.

7.

If the charge-sheet runs into more than 500 pages, the applicant may annex only the relevant documents relied upon. 8.

It is clarified that the Registry/Office shall not raise any objection regarding the legibility of the charge-sheet or its pages. 9.

List the Bail Application on 8 August 2025.
