By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 173 of 2025 registered with Jejuri Police Station, Pune for the offences punishable under Sections 108, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

Mr. Sujay Gangal, learned Advocate for the Applicant submits that subsequent to the order passed in Criminal Bail Application No. 3480 of 2025 dismissing the said Bail Application on 18th June Gitalaxmi

56-BA-2695-2025.doc 2025 and pending the present Bail Application, prosecution has filed charge-sheet in the matter. He therefore on instructions from the Applicant craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Sessions Court, Pune in view of the change in circumstances. 4.

Mr. Amit Palkar, learned A.P.P. for the State/Respondent and Mr. Hrishi Ghorpade, learned Advocate for the Intervenor do not object to the request made by learned Advocate for the Applicant. 5.

In view of the statement made by Mr. Sujay Gangal, learned Advocate, leave granted to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Trial Court. In the event any fresh Bail Application is filed by the Applicant before the learned Trial Court, the same shall be considered on its own merits and in accordance with law. 6.
